If you resided and/or owned residential real property on November 22, 2023, within a three-mile radius centered on the CSX Transportation, Inc. (“CSXT”) train derailment site in Rockcastle County, Kentucky, then you may be a Settlement Class Member and eligible for benefits. Excluded from the Settlement Class are: (i) CSXT; (ii) Class Counsel; (iii) the Judge presiding over the Action; (iv) current employees of CSXT (as of January 6, 2026); and (v) all persons who properly execute and file a timely opt-out request to be excluded from the Settlement Class.

To receive a settlement payment, Settlement Class Members must file a Claim Form by October 19, 2026.

In order to receive payment, Settlement Class Members must submit appropriate proof of residency and/or real property ownership in the Class Area by producing a copy of a utility bill, driver’s license, lease, real property tax assessment invoice, voter registration, or similar official documentation that contains the name of the Claimant and address residential real property.

The deadline to submit a Claim Form online is October 19, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than October 19, 2026.
